EOR vs. PEO: why risk isolation matters for higher education

Many universities are directed toward a PEO (Professional Employer Organization) for remote or temporary hires. It looks like outsourcing. Structurally, it is not. A PEO operates on a co-employment model: your institution and the PEO share legal liability. If the PEO mismanages compliance, ACA tracking, or payroll, your university is still legally on the hook.

The case law is blunt

In Crespo v. State of New York, SUNY used a PEO (Staffco). When an employee was injured, she sued SUNY directly, because the PEO's co-employment structure made the university a liable party. Under an EOR (Employer of Record) model, the EOR is the sole legal employer, fully insulating the institution from direct employment claims.
